In the following, we would like to inform you about how we handle your data when you use our website https://www.swissholidays.com and associated subpages (hereinafter: ‘website’).

II Data security


HAG uses technical and organisational security measures to protect the data against accidental or intentional manipulation, loss, destruction or access by unauthorised persons, taking into account the state of the art, the implementation costs and the type, scope, circumstances and purposes of the processing as well as the different probability of occurrence and severity of the risk. The transmission of personal data between your end device and our server is always encrypted (TLS encryption).



III Provision of the website and creation of log files

To establish and maintain the connection when using the website for information purposes only, only the server log files that your browser transmits to us are automatically collected and stored. When simply viewing the website, the following data, which is technically necessary for the display and for IT security, is therefore collected


- Your IP address

- the HTTP status code,

- the browser type, the browser version,

- the referrer URL (the previously visited page),

- the date and time of the server request,

- the files transferred,

- and the size of the files transferred during the connection.


The personal data listed is also stored in the server log files. This stored data is not merged with other data about you.

2 Legal basis and purpose of data processing


The legal basis for storage is the protection of legitimate interests. The temporary storage of data in log files is absolutely necessary to enable the correct display of the website, to ensure the permanent functionality of the information technology systems and the technology of the website and to optimise the website.


In addition, the data is stored in the interest of recognising, limiting and eliminating attacks on our website.

Stored log files are deleted or anonymised if they are no longer required. As a rule, they are deleted or anonymised after 3 months, provided there are no statutory retention obligations or longer storage is necessary, for example to prevent or clarify an attack on our website (e.g. fraudulent booking, cyber attacks).

V. Tracking tools/website analysis services


Website analysis services ensure a needs-based design and the continuous optimisation of our website and marketing measures. These services are also used to statistically record the use of the website (e.g. number of hits by different users) and to evaluate it for the purpose of optimisation. These interests are to be regarded as legitimate within the meaning of the aforementioned regulations.


Google Analytics

We use Google Analytics, a web analytics service provided by Google Inc (‘Google’), on our websites. Google Analytics uses cookies, which are stored on your end device and enable your use of our website to be analysed. The information generated by the cookie about your use of the website is usually transmitted to a Google server in the USA and stored there.


However, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before transmission and thus anonymised. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. IP anonymisation is active on our websites. Google will use this information on behalf of HAG to analyse your use of the website, to compile reports on website activity and to provide HAG with other services relating to website activity and internet usage. We have concluded an order processing contract with Google.


The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of our website. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.


As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent Google Analytics from collecting data by setting an opt-out cookie that prevents the future collection of your data when you visit our websites. On our website, trbo GmbH, Römerstrasse 6, 80801 Munich (http://www.trbo.com/) collects and stores data from which user profiles are created using pseudonyms in order to provide you with personalised customer benefits. These user profiles are used to analyse visitor behaviour and are evaluated in order to improve and tailor our website to your needs. 3.1 Data transfer to third parties


The processing of your personal data in the context of tracking tools and web analysis services is also carried out by processors. These are involved exclusively on the basis of a data protection agreement.


3.2 Data transfer to third countries


When using Google Analytics, in the exceptional cases described above, your IP address may be transmitted unabridged to Google LLC and only truncated there. Google LLC is in the USA. In the case of Google Analytics, the appropriate level of data protection results from participation in the Privacy Shield Agreement.


VI Travel bookings


1. description and scope of data processing


If you book a trip via our website, you must enter the following personal data in an input mask as part of the booking process:


- Travel applicant:

2 Legal basis and purpose of data processing


The legal basis for data processing is the fulfilment of a contract or pre-contractual measures. We store and use this data to process your travel booking (contract fulfilment).


3. duration of storage


The data will be deleted if it is no longer required to fulfil the contractual relationship/your travel booking. As a rule, it will be deleted after 3 years, provided there are no statutory retention obligations.


4 Recipients of the data


4.1 Data transfer to third parties


We transmit personal data that you enter when booking a trip to your respective tour operator in order to fulfil our contractual obligations as a travel agent.


4.2 Data transfer to third countries


We transfer personal data to third countries outside Switzerland or the EU/EEA. As a suitable guarantee for the legality of these data transfers, we have concluded corresponding data protection contracts with the processors, among other things.


5 Automated decisions


You will only be subject to automated decision-making in exceptional cases if you re-enter a payment method that was previously used to make a failed payment, or if there are otherwise factual indications to suspect a fraudulent booking. In such cases, your request for a travel booking will be rejected by HAG. Such an automatic decision is necessary for the conclusion of the contract. The data subject has the option of contacting us using the above-mentioned contact details (see Section I.) to request an explanation or the intervention of a person or to communicate their point of view.


VII Making contact

If you contact HAG (e.g. by telephone, post or e-mail), the data you provide will be processed to handle your request and answer your question.


The legal basis for data processing is consent and contract fulfilment or contract initiation.


Your data will be deleted after your request has been processed and your questions have been answered, provided there are no statutory retention obligations. Data stored by us for other purposes (e.g. for travel bookings) remain unaffected by this.


If you communicate with us by e-mail, access by third parties cannot be ruled out. HAG therefore recommends sending confidential information by post or using encrypted e-mail communication (PGP). Please let us know if you wish to correspond with us by encrypted e-mail so that we can provide you with information on the relevant addresses and public keys.


VIII. Newsletter


1. description and scope of data processing


We offer you the opportunity to subscribe to our newsletter on our website. The following data entered by you in the registration form, the data technically necessary for registration and the data necessary for legal proof of the registration process will be transmitted:


- Email address

- IP address of the accessing computer

- Date and time of registration

The newsletters also contain so-called tracking pixels. These are files that are retrieved from the server when the newsletter is opened and collect technical information about the browser or device you are using. HAG can also recognise whether and when emails have been opened and links contained therein have been clicked on.

We use the so-called double opt-in procedure for newsletter registration. After your registration, an e-mail will be sent to the e-mail address provided containing a confirmation link to receive the newsletter.

3. purpose of data processing


HAG informs interested parties at regular intervals by newsletter about current offers, voucher promotions, competitions and general travel news. The data you provide for this purpose will be processed exclusively for the purpose of sending you the newsletter. We only collect the other data required for registration in order to prevent misuse of the newsletter service and in particular your e-mail address. The registration process is logged for the purpose of preserving evidence. The statistical evaluation of the newsletter e-mails is carried out for the purpose of optimising the content of the newsletter.


4 Duration of storage


Your newsletter data will be stored for as long as the newsletter subscription is used. The data will be deleted as soon as it is no longer required. As a rule, it is deleted or anonymised after 6 months, provided there are no statutory retention obligations or longer storage is required, for example to log the registration process. Data stored by us for other purposes (e.g. for travel bookings) remain unaffected by this.


5. option to object


You can revoke your consent to receive the newsletter and thus to the use of the associated use of tracking pixels at any time. If you do not wish to receive advertising from HAG about similar products or services, you can object to the corresponding use of your e-mail address at any time without incurring any costs other than the transmission costs according to the basic rates. The cancellation or objection can be made via the link provided in every newsletter or by sending a message to datenschutz@holidays.ch.

The processing of your personal data in the context of sending the newsletter is also carried out by processors. These are involved exclusively on the basis of a data protection agreement.


IX. Competitions


On the website, we offer you the opportunity to take part in various competitions. This requires a one-time registration via a form in which you must enter a valid e-mail address. The information provided will be used exclusively for the prize draw. If you have won a trip, for which your data is required, it will be stored. Otherwise, your data will be deleted immediately after the draw and delivery of the prizes.

If your personal data is processed by HAG, you have the following rights with regard to the personal data concerning you:


Right to information

You have a right to information about your personal data processed by us.

Right to rectification

You have the right to demand the immediate correction of incorrect personal data and the completion of incorrect personal data.


Right to erasure


Under certain circumstances, you have the right to request the erasure of your personal data, in particular if there is no longer a legal basis for the processing.

Right to restriction of processing


Under certain conditions, you have the right to request the restriction of the processing of your personal data, in particular at your request instead of deletion of the data.


Right to data portability

You have the right to request all personal data we have stored about you in a structured, commonly used and machine-readable format and to transmit this data to another controller without hindrance from the controller to whom the personal data was provided.


Right to object


If data is collected to protect legitimate interests, you have the right to object to the processing at any time on grounds relating to your particular situation. If you object to processing based on our legitimate interest, we may nevertheless continue the processing if we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms.


Right to lodge a complaint with the competent supervisory authority
